US regulators have taken legal action against Amazon, alleging that the e-commerce giant is engaging in illegal practices to maintain a monopoly in the market. The Federal Trade Commission (FTC) has accused Amazon of employing a series of anticompetitive and unfair strategies that result in higher prices and hinder competition.

Amazon has responded by stating that the lawsuit is based on incorrect facts and law, and they intend to defend their case in court. This legal action against Amazon is part of a broader effort by US regulators to address the market dominance of major technology companies.

The FTC’s Chair, Lina Khan, has been a vocal critic of Amazon’s business practices for years. In 2017, she published an academic article arguing that Amazon had avoided sufficient antitrust scrutiny despite its growing market influence. Since her appointment as FTC Chair in 2021, many anticipated that she would take action against Amazon, making this case a significant test of her leadership.

The dominance of a few major tech firms has raised concerns among some US politicians, who have called for measures to promote competition in online search, retail, and social media. However, despite strong rhetoric against Big Tech, the FTC under Khan’s leadership has faced challenges in pursuing antitrust cases. For example, the FTC failed in its attempt to prevent Meta (formerly Facebook) from acquiring the VR company Within and Microsoft’s acquisition of the maker of Call of Duty.

In this case against Amazon, the FTC, along with 17 state attorneys, argues that Amazon is a monopolist that prevents competitors and sellers from offering lower prices. They also allege that Amazon’s actions harm product quality, overcharge sellers, stifle innovation, and hinder fair competition.

Amazon counters that if the FTC’s lawsuit succeeds, it could lead to reduced product choices, higher prices, and slower deliveries for consumers. Proving anticompetitive behavior in the tech industry can be challenging because many services, like Google’s search engine or Meta’s Instagram, are offered for free, and prosecutors must demonstrate that such practices harm consumers financially.

This legal action against Amazon is part of a broader effort by regulators to address antitrust concerns in the tech industry and promote fair competition. The outcome of this case will be closely watched, as it could have significant implications for the future of competition in the e-commerce and tech sectors.
